What is allowing kids to “use” their name in high school for NIL?

Nick Stevens, High School OT, on why a student in Greensboro, NC is suing the state for limiting his use of NIL. What rule, specifically, is this athlete referring to that the public schools are not able to do but private schools might be? Reading between the lines at THIS meeting, Nick believes something will have to be done to allow NIL in high school.
